Customers must read and accept our terms and conditions. The Expedition staff consists of Runa Lindberg and Urip Dunker.

 

1. registration and conclusion of the contract:

Registration for workshops can be done online via the registration form, by e-mail, in person or via a third party (Facebook, MeetUp, Eventbrite)

 

With the registration the participant accepts the conditions of participation.

 

 

The registration will be confirmed by e-mail. With the receipt of the confirmation of registration, the registration is final and binding, but can be revoked within 14 days. Registrations will be considered in the order in which they are received. In case of overbooking the Expedition staff will create a waiting list.

If a place is available or if the Expedition staff name an additional workshop date, information will be sent immediately by e-mail.

 

2. maturity and payment:

 

After receipt of the booking confirmation, the entire participation fee must be paid within 14 days, unless it is stated differently in the contract.

The payment is made by bank transfer. If the written registration is received less than 30 days before the workshop date, the entire participation fee must be paid within 7 days, but no later than the beginning of the workshop.

 

3. offers and prices:

 

The number of participants (maximum and minimum number) will be determined by the Expedition staff.

Scope of services and important information on the workshops are included in the respective call for proposals.

Costs for food, travel and accommodation are included in the participation fee will be settled separately, by our partner travel agency. These are included or exclusive depending on the workshop offered.  You can find information about this in the corresponding offer.

 

 

4. cancellation:

 

The participant may withdraw at any time before the start of the workshop. Decisive for this is the receipt of the declaration of withdrawal by the Expedition staff. The withdrawal must be declared in writing by e-mail or post.

 

If the cancellation is made later than 50 days before the start of the workshop, the Expedition staff will charge a staggered administration fee:

Cancellation 49 to 30 days prior to the workshop: 30% of the workshop fee.

Cancellation 29 to 15 days before the workshop: Cancellation 50% of the workshop fee .

Cancellation 14 to 8 days before the workshop: Cancellation 70% of the workshop fee.

Cancellation from 7 days before the start of the workshop or in case of no-show: 100% of the workshop fee.

4.1 Cancellation due to Covid-19:

If, due to Covid-19, the health of the participants or the photo trainer cannot be guaranteed, the workshop will be cancelled and the participants will get their participation fee refunded, minus a handling fee of 20€ (for local domestic workshops) or 100€ (for international photo tours) per person in case payments have been made by adventureinfocus, for example for hotel reservations. This also applies in case of a lockdown, for example. If a participant cannot attend the workshop at short notice because he/she may be infected by Covid-19, he/she can cancel the workshop and will be refunded the participation fee minus a handling fee of 50€ (domestic workshops) or 200€ (international photo tours). These regulations are valid for the time being until 31.12.2020.

5. resignation by us:

 

The Expedition staff reserves the right to cancel the workshop at short notice in special cases.

This applies in particular if the minimum number of participants is not reached or if other important reasons prevent the organisation of a workshop. In this case already paid participation fees will be refunded immediately.

Further claims are excluded.

 

 

6. program changes:

 

In exceptional cases, changes to the workshop programme or the course of the workshop are possible and can be made by the Expedition staff at their own discretion. The participation fee will not be refunded in these cases.

Program changes caused by bad weather conditions do not entitle to a refund of the participation fee.

 

 

7. liability:

  • The Expedition Staff acts in the capacity of an agent with regards to legal conditions. The Expedition Staffs organises, promotes and sells the Expedition along with the services they buy from other suppliers. The Expedition staff is only responsible for the photo-coaching. The suppliers are independent contractors and are not agents or employees of the Expedition Staff. They provide services that include, but are not limited to, transportation, lodging, meals and excursions using local guides. While the Expedition Staff strives to make arrangements with reputable suppliers and directly to test their services in first person, the Expedition Staff is not responsible for the voluntary or negligent acts or omissions of such providers, their employees, agents, servers or representatives, including, without limitation, their failure or insufficiency provision of services. All the arrangements of the Expedition are subject to the terms and conditions specified by the providers, airlines and/or applicable laws. Customers acknowledge that the Expedition Staff can not assume any responsibility for losses or additional expenses due, among others to delays, inconveniences, changes or cancellation of itinerary, illness, weather, strike, war, quarantine, terrorism, defects in vehicles, damage to equipment, animals including transportation by animals, hiking, and any act, omission, negligence or any other services related to the completion of the Expedition or other causes beyond the control of the Expedition Staff. When every reasonable precaution is applied by the Expedition Staff, all these losses or expenses will be borne by the Customers.

  • The Expedition Staff will also not be held responsible in particular, for any problem concerning international or domestic flights such as but not limited to delay, cancellation, loss or damage of luggage, etc. In case of any problems such as, but not only, cancellation, delay, timing changes, damage or loss of luggage the Customers will have to contact directly the airline company in order to check their terms and conditions as the airline policies vary by carrier, the type of fare, etc. The Expedition Staff cannot accept any responsibility for losses or additional expenses in the airfare due to the cancellation or alteration of the Expedition. For this reason, the Expedition Staff strongly suggests reserving a refundable fare or purchasing the optional insurance in case the Expedition should be canceled, postponed or altered.

  • By registering in the Expedition, Customers certify that they have carefully read the calendar of activities and the "Terms and Conditions" and they are aware that the Expedition could involve the risk of personal injury, death or loss (damage) to property. In consideration of the benefits derived from the Expedition, Customers voluntarily acknowledge and accept all the risks of the same.

  • Customers agree on behalf of themselves, their dependents, heirs, executors and assigns, to release and keep safe the Expedition Staff, its employees, subsidiaries, affiliates, officers, directors, successors, representatives, assignees and their operators (hereinafter referred to as "Contributors") of any claim, including but not limited to liability for delays, monetary damages, illness, injury, death or loss or damage to property resulting directly or indirectly from any occurrence or condition.

  • Customers are responsible for possessing a valid passport and all required visa permits at the time of travel, as well as making arrangements for all required vaccinations or any other requirements for each of the countries visited during the Expedition. The Expedition Staff will provide information about these requirements, but any recommendations about these matters and related subjects will be given in good faith and without any responsibility on the part of the Expedition Staff. The Expedition Staff will not be responsible if Customers are denied entry or transit into a country if they are unable to provide valid documents as per the country’s requirement. Reliable and most current information regarding international travel can be found by contacting the consulate/embassy of the country(s) Customers are visiting or transiting through.

  • Customers affirm that they are covered by a medical insurance (read "Medical Insurance & Medical Information" section for further details), which is valid abroad and they affirm that they have not relied on any additional oral or written representation of the Expedition Staff for the execution of this release.

  • Customers are voluntarily taking part in the Expedition with the knowledge that it involves some inherent risks and hazards, including, but not limited to, the forces of nature, civil unrest, strikes, wildlife (including animals used for transportation), all activities that include hiking on rugged terrain, theft, cancellation or changes in itinerary, negligent actions of others or their agencies, or means of transport or accommodation that can not be operated or maintained to standards common in western countries. This includes problems related to health and the awareness that medical services or facilities may not be readily available or accessible during all or part of the Expedition. This includes emergency medical attention, the presence of doctors and proper medication.

  • In travels of this type it is not possible to accommodate people with serious health problems, physical disabilities or mental illness. Anyone with a normal physical condition will be able to participate in most activities on the Expedition. It is possible to experience general fatigue due to flights and changes in time zones. Customers will have to be agile enough to get on and off the transport vehicle and be able to carry and manage his/her own photographic equipment and luggage. Customers will walk trails and trails that range from easy to moderate throughout the Expedition. It is the responsibility of the Customers to judge the adequacy of the Expedition activities to their own physical and mental capacities. By submitting the deposit, Customers certify that they agrees to these terms and conditions and that they do not have any mental or physical condition or any other disability that could create danger for them or other participants. The Expedition Staff assumes no responsibility for special arrangements or problems incurred by Customers unable to participate in the Expedition or planned activities. All Customers should assess their physical fitness prior to booking to ensure that they meet the requirements for the activities that they will complete during the Expedition. If additional information about fitness requirements for specific activities is required for an accurate evaluation, it is the responsibility of the Customers to request this information from the Expedition Staff. Customers with existing medical conditions or other health problems should consult with their doctor about their ability to complete the scheduled activities prior to booking the Expedition.

  • The Customers agree to accept the authority and decisions of the Expedition Staff and guides during the Expedition. If it is determined that the behavior or health of one or more Customers either before or during the Expedition may be an endangerment to themselves or to others or result in severe discomfort for other people, those Customers may be excluded from all or part of the Expedition.

  • The Expedition Staff reserves the right to decline a booking at its discretion.

8. Medical insurance and medical information

  • Due to possible changing conditions in India, Customers should consult their own family doctor/general practitioner before the start of the expedition about mandatory vaccinations or recommendations and/or prophylaxis to enter India.

  • It is essential that Customers with medical conditions and/or special dietary restrictions make them known in advance in order to accommodate their request.

  • When registering for the Expedition, Customers have to inform in advance with any special needs (such as but not limited to allergies, medications they are currently taking that may affect their health, etc...) or any physical/mental condition that they think might affect their health from fully participating.

  • Please note that medical services and facilities may not be available during all or part of the Expedition. This could include emergency medical attention, presence of doctors or proper medication.

 

9. Code of conduct

  • All Customers participating in the Expedition are required to obey all applicable local laws and regulations in the country that they visit. Failure to do so will immediately relieve the Expedition Staff from any obligations that would otherwise apply under these booking conditions.

  • Customers are expected to behave in a manner that is respectful of the group and other Customers.

  • Any use of illegal drugs or substances, committing or participating in any criminal or illegal activity and violence of any kind will not be tolerated and will result in the immediate withdrawal of the participant(s), without reimbursement and at the expense of the Customers.

  • Expedition Staff is authorised and reserves the right to withdraw or exclude Customers or any part thereof, for actions that they deem inappropriate or detrimental to the group or Expedition.

  • If Customers have a complaint about any of the Expedition activities or other arrangements, they must bring it to the attention of the Expedition Staff as soon as reasonably possible. It is important that any complaints or concerns about the Expedition itself be communicated to the Expedition Staff at the Customers earliest convenience in order for the situation to be addressed, and if possible, remedied, as soon as possible.

8.  Photography

  • The Expedition Staff reserves the right to take photographs or videos during the Expedition and use the resulting photographs, videos or recordings for promotional or commercial use. When making a reservation in the Expedition, Customers accept that their image is used by the Expedition Staff without compensation for the participant (model release). Customers preferring that their image will not be used at that purposes must notify it in writing before the departure of the Expedition.

  • In the same way, the Expedition Staff accepts that their image could be used by Customers.

  • Copyright in all photographs, videos and other related materials created by the Customers will be the property of the Customers at the time of creation.

  • Customers grant the Expedition Staff a non-exclusive, worldwide and irrevocable license to use those materials provided voluntarily in any medium for the following purposes: editorial use, promotion of this editorial use, advertising and promotion of travels offered by the Expedition Staff. Of course, a credit to the owners of the copyright will be always included by the Expedition Staff when their photographs/videos will be used
